Ben Sulayem & FIA seeks rule changes

There are a lot of strange things happening inside of the FIA, this post is about Ben Sulayem's tenure and the rule changes seek by the FIA.

✮ Ben Sulayem's tenure

Ben Sulayem's tenure has been controversial to say the least, departure of senior stuff, allegations of interfered, ban on swearing, piercings and underwear and so much more.
This year we have seen a bunch of senior staff left the organization, BBC Sport made a list: sporting director, F1 technical director, chief executive officer, digital director, head of commercial legal affairs, governance and regulatory director, race director, compliance officer, a leading steward and deputy steward, the head of the women in motorsport commission, secretary general of mobility and director of communications, and three most senior HR staff.

⟡ Bertrand Badre and Tom Purves: head of the audit committee and audit committee member, respectively, were fired after investigating about three separate issues:
- Alleged inappropriate use of the president's expenses
- The departure of Robyn as CEO
- The $1.5m president’s fund to pay member clubs, which vote for the FIA president.
Neither of these investigations were progressed.

⟡ Paolo Basarri: the compliance officer, who looked into the allegations and reported them to the ethics committee, was fired last month.

But that's not all, there were two separate allegations that Ben Sulayem interfered in the operations of grands prix in 2023, which were dismissed.

→ Las Vegas Grand Prix: seek to force the race director not to certify the track before its first race.

The most recent departure were:
⟡ Niels Wittich, F1 race director, who was replaced by Rui Marques.
The FIA said he steps down "to pursue new opportunities", while Wittich said “I have not resigned.”
According to Craig Slater, from Sky Sports,  he was fired, his sources said that the relationship between Wittich and the FIA president Mohammed Ben Sulayem was also somewhat at odds”

⟡ Tim Mayer, former FIA steward, about being fired via text from one of Ben Sulayem's assistants., for the BBC, he said:

"The official reason that will be given is they felt there was a conflict of interest with the FIA as I had led the right of review in my role as organizer."

Because Cota succeeded in having the language of the right of review verdict changed, Mayer said that Ben Sulayem felt an element in the right of review paperwork "was a personal attack on him".

⟡ Janette Tan, has been removed from the role she was meant to take, she was supposed to be, Rui Marques successor, as race director in managing F2 sessions

✮ The FIA rule changes

The FIA seeks rule changes to limit the ways its leadership can be held to account for bad governance, after president allegations.
The FIA general assembly on 13 December will vote on a set of revisions to the statutes governing the audit and ethics

In Benson's publication on the BBC Sports, he brings some information about the rule changes:

These changes to the statutes would remove:
- the power of the audit committee to investigate financial issues independently 
- the ability of the compliance officer to report to the audit committee
- the audit committee's ability to investigate any matter unless asked by the president of the senate.
- the role of the senate and compliance officer in its operations

And it would ensure that:
- any ethics complaints were overseen by the FIA president and president of its senate, rather than the senate itself.
- the FIA president controls the appointment of the head of the ethics committee

The FIA president would be allow to investigate the president of the FIA Senate, while president of the FIA Senate would be allow to investigate the FIA president. But who is the president of the FIA Senate?

O mandato de Ben Sulayem foi controverso, para dizer o mínimo, com saída de altos funcionários, alegações de interferência, proibição de palavrões, piercings e roupas íntimas e muito mais.

As mudanças nas regras da FIA
A FIA busca mudanças nas regras para limitar as maneiras como sua liderança pode ser responsabilizada por má governança, após alegações do presidente.
A assembleia geral da FIA votará em 13 de dezembro em um conjunto de revisões dos estatutos que regem a auditoria e a ética

Na publicação de Benson na BBC Sports, ele traz algumas informações sobre as mudanças nas regras:

Essas mudanças nos estatutos removeriam:
- o poder do comitê de auditoria de investigar questões financeiras de forma independente
- a capacidade do diretor de conformidade de se reportar ao comitê de auditoria
- a capacidade do comitê de auditoria de investigar qualquer assunto, a menos que solicitado pelo presidente do senado.
- o papel do senado e do diretor de conformidade em suas operações

E garantiria que:
- quaisquer reclamações de ética fossem supervisionadas pelo presidente da FIA e pelo presidente de seu senado, em vez do próprio senado.
- o presidente da FIA controla a nomeação do chefe do comitê de ética
